Read this notice carefully before booking or participating. Entry into the Rope Adventure Park constitutes acceptance of all terms below.

IMPORTANT NOTICE: This document is provided in compliance with Section 49 of the Consumer Protection Act 68 of 2008 and draws attention to risks, indemnities, and limitations of liability that may result in serious injury or death. Acceptance applies equally to online bookings, on-site participation, and entry into all activity areas.

Section 01

Assumption of Risk

Chimp & Zee Rope Adventure Park is an adventure activity operated at Pines Resort, Krugersdorp. Participation involves physical activity at height, movement across obstacles, and ziplining above ground and water features. These activities carry inherent risks, and participation is entirely voluntary and at the participant's own risk.

The Rope Adventure Course consists of elevated platforms, hanging elements, obstacles, and zip lines ranging from approximately 2 metres to 5 metres above ground level.

Participants acknowledge that falling is an inherent danger and voluntarily assume all risks including:

  • Slips, trips, and falls from height
  • Collisions with obstacles, platforms, or other participants
  • Equipment interaction and mechanical failure
  • Physical exertion, fatigue, and heat-related illness
  • Weather-related hazards including wind, rain, and lightning
  • Acts or omissions of other participants

By proceeding with a booking or entering the Rope Adventure Park, participants confirm they have read, understood, and voluntarily accept all risks outlined in this notice.

Section 02

Participation at Own Risk & Limitation of Liability

All visitors participate entirely at their own risk.

To the fullest extent permitted by South African law, Pines Resort, Chimp & Zee Rope Adventure Park, and their respective owners, members, directors, employees, agents, instructors, contractors, representatives, and lessees shall not be held liable for any injury, loss, damage, illness, or death arising from:

  • Participation in the Rope Adventure Park or use of its facilities
  • Negligence or any other cause on the part of the Operators
  • Equipment failure, defect, or malfunction
  • Acts or omissions of fellow participants
  • Weather conditions or acts of nature
  • Failure by a participant to follow instructions or safety rules

Liability is excluded in all circumstances except where it arises directly from the gross negligence or wilful misconduct of the Operators.

Section 03

Safety Rules, Briefings & Instructions

Compliance with all safety rules and instructions is mandatory. All participants are required to:

  • Attend and pay full attention to the mandatory safety briefing before starting the course
  • Comply with all posted safety signage throughout the course
  • Follow all verbal and visual instructions provided by Rope Course guides
  • Adhere to the Rope Adventure Park Safety Plan and all operational rules
  • Keep hands off the top steel cable at all times
  • Move only horizontally along obstacles — no vertical climbing
  • One person per obstacle at any time
  • A maximum of two people may be on platform poles simultaneously
  • Wait for the person ahead to clear the zipline before proceeding
  • Not deliberately delay other participants on the course
  • Call a guide immediately if assistance, injury, or distress occurs

Participants may not adjust, remove, or interfere with harnesses, carabiners, lanyards, safety attachments, or trolleys.

Failure to comply with safety rules may result in immediate removal from the course without refund.

Section 04

Safety Equipment & Continuous Belay System

Chimp & Zee Rope Adventure Park operates a specialised continuous belay safety system. Once connected at the start of the course, participants remain attached to the safety line for the entire duration. Accidental disconnection is physically prevented by the system design.

All required safety equipment is provided, including harnesses, helmets where applicable, and lanyards.

While safety systems significantly reduce risk, no safety system can guarantee that injury will not occur.

Section 05

Participation Requirements & Restrictions

The following requirements are checked at reception before every session. Participants who do not meet these requirements will be refused access without refund.

Participation is strictly prohibited during pregnancy for any reason.

BASIC
Must be able to climb stairs unaided. Reasonable physical fitness required.
Section 06

Minors, Parents & School Groups

  • A minor is any person under the age of 18 years
  • Minors must be supervised by a parent, guardian, educator, or designated responsible adult at all times
  • Parents and guardians remain fully responsible for the behaviour and supervision of minors
  • For school group bookings, the visiting school remains fully responsible for all learners at all times
  • Rope Adventure Park staff and guides do not replace parental or educator supervision
  • Valid parental consent, indemnity, and POPIA consent forms are mandatory for all minors
  • School groups must submit a completed group indemnity and consent form prior to their visit

Failure to produce valid consent documentation for minors will result in refusal of access without refund.

Section 07

Medical & Physical Fitness

Each participant is solely responsible for ensuring they are physically and medically fit to participate. Participation is not recommended without prior medical clearance for individuals with:

  • Heart conditions or cardiovascular disease
  • Epilepsy or seizure disorders
  • Severe vertigo, acrophobia, or balance disorders
  • Recent surgery, fractures, or musculoskeletal injuries
  • Respiratory conditions aggravated by exertion
  • Any condition for which a medical professional has advised against physical activity

Chimp & Zee reserves the right to refuse participation where safety may be compromised. This decision is final and no refund will be issued.

Section 08

Time Slots, Late Arrivals & Course Flow

  • Participants must arrive at least 15 minutes before their booked time slot
  • Strict adherence to the allocated time slot is required
  • Late arrivals may be required to reschedule and may forfeit their booking without refund
  • Participants must move through the course at a reasonable pace without deliberately delaying others
  • Guides may ask participants to move on or wait at specific points to manage course flow
Section 09

Weather & Operational Closures

The Rope Adventure Park may close temporarily or fully without notice due to:

  • Lightning, thunder, or electrical storms in the area
  • High winds or gusts exceeding safe operating thresholds
  • Heavy rain or slippery course conditions
  • Any other weather or safety-related circumstances at management's discretion

Where closure is required in the interest of participant safety, no refunds or rescheduling will apply. Weather-related closures do not constitute a breach of contract.

In the event of a pre-session closure, management may at its sole discretion offer rescheduling where operationally feasible. This is a goodwill gesture and does not create a legal obligation.

Section 10

Refunds & Rescheduling

  • No refunds for participants who are unable, unwilling, or choose not to complete the course
  • No refunds for participants refused entry due to failure to meet safety requirements
  • No refunds for participants removed for failure to follow safety rules
  • Rescheduling requests must be submitted at least 5 hours prior to the booked time slot
  • Late rescheduling or no-shows result in forfeiture of the full ticket value
  • No walk-ins permitted — advance booking required at all times
  • All bookings subject to Webtickets terms and conditions
Section 11

Photography, Video & Media Consent

By participating, participants grant Chimp & Zee Rope Adventure Park and Pines Resort the right to photograph and/or video record participants for use in:

  • Marketing, promotional, and advertising materials
  • Social media platforms and digital content
  • Website and print media

No compensation will be payable. Participants who do not consent must notify staff in writing at check-in.

The use of drones is strictly prohibited without prior written authorisation.

Section 12

POPIA & Personal Information

Chimp & Zee Rope Adventure Park collects and processes personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).

What we collect

Name, contact details, age/date of birth, height, weight, medical disclosures, and booking information.

Why we collect it

To process bookings, ensure participant safety, comply with legal obligations, and manage the activity.

Who we share it with

Pines Resort operations staff, emergency services where required, and Webtickets. We do not sell personal information.

Your rights

You may request access to, correction of, or deletion of your personal information by contacting info@ropepark.co.za.

Minors' data

Personal information of minors is collected with explicit parental/guardian consent only.

Data security

We implement reasonable technical and organisational measures to protect personal information against loss or unauthorised access.

Section 13

Governing Law & Jurisdiction

This disclaimer is governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

This disclaimer must be read in conjunction with:

  • The Consumer Protection Act 68 of 2008
  • The Protection of Personal Information Act 4 of 2013 (POPIA)
  • The Occupational Health and Safety Act 85 of 1993
  • Any applicable regulations under the above legislation

Legal note: This disclaimer has been drafted in compliance with Section 49 of the Consumer Protection Act, which requires that limitations of liability and assumptions of risk be drawn to the attention of the consumer in a conspicuous manner.
