IMPORTANT NOTICE – ASSUMPTION OF RISK & LIMITATION OF LIABILITY
Chimp & Zee Rope Adventure Park is an adventure activity operated at Pines Resort. Participation involves physical activity at height, movement across obstacles, and ziplining above ground and water features. These activities carry inherent risks, and participation is entirely voluntary and at the participant’s own risk.
By accessing this website, making a booking, entering the Rope Adventure Park, or participating in any Rope Adventure activity, you acknowledge that you have read, understood, and accepted the terms of this disclaimer.
1. Assumption of Risk
The Rope Adventure Course consists of elevated platforms, hanging elements, obstacles, and zip lines, ranging from approximately 2 metres to 5 metres above ground level. Activities involve balance, strength, coordination, speed, and physical exertion.
Participants acknowledge that falling is an inherent danger of rope adventure activities and voluntarily assume all risks associated with participation, including but not limited to slips, falls, collisions, equipment interaction, physical exertion, fatigue, or weather-related conditions.
2. Participation at Own Risk
All visitors participate entirely at their own risk.
To the fullest extent permitted by South African law, Pines Resort, Chimp & Zee Rope Adventure Park, and their owners, members, directors, employees, agents, instructors, contractors, representatives, and lessees shall not be held liable for any injury, loss, damage, illness, or death arising from participation in the Rope Adventure Park or use of its facilities, whether arising from negligence or any other cause, except where liability arises directly from gross negligence or wilful misconduct.
3. Safety Rules, Briefings & Instructions
All participants are required to:

Attend the mandatory safety briefing before starting the course

Comply with all posted safety signage

Follow all verbal instructions provided by Rope Course guides

Adhere to the Rope Adventure Park Safety Plan and operational rules
Participants may not adjust, remove, or interfere with harnesses, carabiners, lanyards, safety attachments, or trolleys. Safety equipment may only be fitted, adjusted, or removed by trained Rope Course guides.
Failure to follow safety rules, including rules relating to obstacle limits, zipline sequencing, and platform capacity, or to follow instructions, may result in immediate removal from the course without refund.
4. Safety Equipment & Continuous Belay System
Chimp & Zee Rope Adventure Park uses a specialised continuous belay safety system, designed to keep participants connected to the safety line at all times throughout the course. While safety systems significantly reduce risk, they do not eliminate risk entirely.
No safety system can guarantee that injury will not occur.
5. Participation Requirements & Restrictions
Participation is subject to the following mandatory requirements:

Minimum height: 1.2 metres

Maximum weight: 120 kilograms (all participants will be weighed at reception)

Reasonable physical fitness and mobility

Participation is not permitted for pregnant individuals
Children shorter than 1.2 metres are not recommended to participate and may be unable to complete the course. Children under 1 metre are strictly prohibited from participating.
Failure to meet participation requirements may result in refusal of access or removal from the course without refund.
6. Minors, Parents & School Groups

Minors must be supervised by a parent, guardian, educator, or designated responsible adult at all times.

Parents and guardians remain responsible for the behaviour and supervision of children.

For school group bookings, the visiting school remains fully responsible for the supervision, behaviour, and discipline of learners at all times.

Rope Adventure Park staff and guides do not replace parental or educator supervision.

Valid parental consent, indemnity, and POPIA consent forms are mandatory for all minors and school group bookings.
7. Medical & Physical Fitness
Participants are responsible for ensuring that they are physically and medically fit to participate. Participation is not recommended for individuals with medical conditions, injuries, or limitations that may compromise safety.
Chimp & Zee Rope Adventure Park reserves the right to refuse participation where, in its reasonable opinion, safety may be compromised.
8. Time Slots, Late Arrivals & Course Flow
Participants must adhere strictly to their selected time slot. Late arrivals may be required to reschedule and may forfeit their booking. Participants are expected to move through the course without deliberately delaying others.
9. Weather & Operational Closures
The Rope Adventure Park may close temporarily or fully due to weather conditions (including lightning or high winds) or other safety concerns. Closures may occur at management’s discretion.
Where closure is required in the interest of safety, no refunds or rescheduling will apply.
10. Refunds & Rescheduling

No refunds are issued for participants who are unable, unwilling, or choose not to complete the course.

Rescheduling requests must be made at least 5 hours prior to the booked time slot.

No walk-ins are permitted; advance booking is required.

11. Acceptance of Disclaimer
By accessing this website, purchasing a ticket, entering the Rope Adventure Park, or participating in any Rope Adventure activity, you confirm that you:

Have read and understood this disclaimer;

Accept the inherent risks associated with the activity; and

Agree to comply with all rules, signage, safety briefings, and instructions.
This disclaimer forms part of the terms and conditions of entry and participation.
This notice is provided in compliance with Section 49 of the Consumer Protection Act and draws attention to risks, indemnities, and limitations of liability that may result in serious injury or death.
Acceptance of this disclaimer applies equally to online bookings, on-site participation, and entry into restricted activity areas.
